Film Partnerships

Film partnerships can be a highly effective tax shelter if your circumstances are right.

What tax benefits are available?
  • Income and capital gains shelter (current year and three year carry back).
  • Particularly useful to people with significant income tax liabilities.
  • 100% tax relief on gross investment.

What is a film partnership?
  • Film partnerships have resulted from tax incentives introduced to help finance the UK film industry.
  • They involve sale-and-leaseback deals on the distribution rights of films that have already been made.

How do they work?
  • Up to 19 investors put money into a general partnership set up to buy film rights or fund a TV production.
  • Minimum cash subscription normally £25,000.
  • Investors usually fund around 25% of the total funding requirement.
  • The partnership buys distribution rights in qualifying films from a film producer.
  • The partnership leases the distribution rights back to the producer on a long lease (max.15 years).
  • The producer makes lease payments to the partnership that equals the capital and interest repayments on the bank loan making the investment neutral in capital terms.
  • The whole of the investment (investor contribution and the amounts lent by the bank) qualifies for tax relief in the first year because the partnership can write off 100% of the acquisition costs of the film.
  • So on £100,000 film purchase there will be a tax rebate of £40,000 for an outlay of only, say, £25,000.

  • Film partnerships are medium to long term investments.
  • Careful consideration is necessary to ensure that a film partnership investment is suitable for you in the light of your personal circumstances and attitude to risk.
  • You should not invest until you have read and understood the partnership documents.
